General Terms and Conditions (GTC)
TRN Nutrition GmbH

Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts concluded between TRN Nutrition GmbH, Lorystraße 83/1/45, 1110 Vienna, Austria (hereinafter referred to as “TRN Nutrition”) and its customers.
1.2 Any deviating, conflicting or supplementary general terms and conditions of the customer shall not become part of the contract unless TRN Nutrition expressly agrees to their validity in writing.

Conclusion of contract

2.1 The presentation of the products on the website does not constitute a legally binding offer, but rather an invitation to place an order. Errors excepted.
2.2 By clicking the "Order with payment" button, the customer submits a binding offer to purchase the goods contained in the shopping cart. Confirmation of receipt and acceptance of the order will be sent via an automated email immediately after submission. This email confirmation constitutes the conclusion of the purchase contract.

Prices and payment

3.1 The prices stated on the website include the applicable statutory value added tax and exclude shipping costs.
3.2 Payment is made in advance, by credit card, PayPal, or one of the payment methods offered on the website. TRN Nutrition reserves the right to exclude certain payment methods in individual cases.

Delivery

4.1 Delivery takes place within Austria and to the countries listed on the website.
4.2 Delivery times are specified on the website. If not all ordered products are in stock, TRN Nutrition is entitled to make partial deliveries at its own expense, provided this is reasonable for the customer.
4.3 If delivery fails after three delivery attempts for reasons attributable to the customer, TRN Nutrition may withdraw from the contract. Any payments already made will be refunded to the customer immediately.

Right of withdrawal

5.1 Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which the customer or a third party other than the carrier designated by the customer takes possession of the goods.
5.2 To exercise the right of withdrawal, the customer must inform TRN Nutrition of the decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail).
5.3 In the event of cancellation, the customer must return or hand over the goods to TRN Nutrition immediately and in any event no later than fourteen days from the date on which he notified TRN Nutrition of the cancellation of the contract.

Warranty and liability

6.1 The statutory warranty rights apply.
6.2 TRN Nutrition is liable without limitation in cases of intent and gross negligence. In cases of slight negligence, TRN Nutrition is only liable for breaches of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on whose compliance the customer regularly relies. In these cases, liability is limited to the damage foreseeable and typically occurring at the time the contract was concluded.
6.3 The above limitations of liability shall not apply to damages resulting from injury to life, body or health.

Data protection

7.1 TRN Nutrition collects, processes and uses the customer’s personal data to process the contract and maintain the customer relationship.
7.2 Further information on data protection can be found in the privacy policy on the TRN Nutrition website.

Final provisions

8.1 Contracts between TRN Nutrition and the customer are subject to the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods.
8.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships shall be the registered office of TRN Nutrition.
8.3 Should individual provisions of these General Terms and Conditions be invalid, the remaining provisions of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provisions.
